The rights of mental patients were linked to the civil rights movement. This conception emphasized due process and equal protection as the essential constitutional doctrines. When applied to the psychiatric context these doctrines produced two kinds of litigation. One emphasized rights even where they interfere with the patient’s needs. The other emphasized needs and attempted to express those needs as rights. (48 pp.)
